Sample Language for Your Will or Trust

The following language may help you and your attorney draw up a bequest that meets your needs.

“I hereby give to the Tower Foundation of San Jose State University (Tower Foundation), a not-for-profit corporation currently located at University Advancement, One Washington Square, San Jose, CA 95192, or its successor thereto, $_________ (or % of Estate, % of Estate Residue). After, or contemporaneously with, the execution of this Trust, I may create a nonbinding written record with the Tower Foundation that details how this gift will be directed after my passing. If such documentation exists, the Tower Foundation will refer to the most updated documentation it has on file when directing the Settlor’s gift internally. If no documentation is on file with the Tower Foundation, this gift shall be used to support ___________________________.

If at any time in the judgment of the Tower Foundation, it is impossible or impractical to carry out the purposes set forth above, the Foundation shall use the funds for a purpose as near as practical to the above-restricted purpose, as determined by its Board of Directors.”
